These Terms & Conditions ("Terms") govern your use of Colen ("Colen", "we", "us"). By using Colen, you agree to these Terms. Please read them carefully.

1. Description of Service

Colen provides a platform for automatically generating and hosting websites for local businesses based on Google Maps data and user input, using AI to draft copy and select photos.

2. Identity Verification

To claim a business listing, we verify you are authorized to represent it via a one-time SMS or automated voice passcode sent to a phone number associated with the listing. By requesting verification, you consent to receive this one-time message or call; it is not a recurring or marketing communication, and standard message/data rates may apply.

3. AI-Generated Content

Website copy, photo selections, and other content are generated with the help of AI, and your site is published automatically as part of that process. AI-generated content can be inaccurate or unsuitable. You should review your site promptly after it's created and correct anything wrong — including menu items, prices, hours, and descriptions — using your dashboard. Colen is not liable for inaccuracies in automatically generated content that you have not corrected.

4. User Responsibilities

You are solely responsible for the accuracy of the information on your generated website, including menu items, prices, and operating hours. You must hold the necessary rights to any photos, logos, or text you upload, and confirm you are authorized to represent the business you are claiming.

5. Subscriptions & Billing

Pro features, such as custom domains, require an active subscription. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period, and you keep Pro access until then. See our Refund Policy for details on refunds.

6. Custom Domains

If you connect a custom domain to your site, that domain belongs to you and is registered through your own domain registrar. You are responsible for purchasing, renewing, and maintaining it. Colen only connects your existing domain to your site; we do not sell, register, or renew domains on your behalf, and we are not responsible for any cost, expiration, or loss of a domain that happens outside our service.

7. If Your Subscription Lapses

If a Pro subscription is cancelled or payment lapses, your site is not taken down or deleted for non-payment alone. It reverts to the free tier — Pro-only features (such as a custom domain) are turned off, but your site stays live and your data is kept, so you can resubscribe without starting over.

8. Service Availability

We aim to keep Colen and published sites available, but we don't guarantee uninterrupted uptime. If we ever need to significantly change or discontinue the service, we will make reasonable efforts to notify account holders in advance and provide an opportunity to export your site content.

9. Acceptable Use

You may not use Colen to host illegal, offensive, fraudulent, or copyright-infringing material, or to claim a business you are not authorized to represent. We reserve the right to suspend or terminate accounts that violate this policy, with or without notice.

10. Termination

You may stop using Colen and delete your account at any time. We may suspend or terminate access to any account that violates these Terms or poses a security or legal risk to the service or other users.

11. Disclaimer of Warranties

Colen is provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose or uninterrupted availability.

12. Limitation of Liability

To the maximum extent permitted by law, Colen is not liable for any indirect, incidental, or consequential damages, including business losses, loss of profits, or data loss, resulting from use of the service or any downtime. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim arose.

13. Indemnification

You agree to indemnify and hold Colen harmless from any claims, damages, or expenses arising from content you publish through the service, your violation of these Terms, or your infringement of any third party's rights.

14. Disputes

If a dispute arises, please contact contact@colen.app first so we can try to resolve it directly and in good faith before either party pursues any other remedy.

15. Changes to These Terms

We may update these Terms as the service evolves. Material changes will be reflected by updating the "Last updated" date above; continued use of Colen after a change means you accept the revised Terms.
